Are your company rates too high? It's a question you'll find difficult to answer and no wonder. Rating law is constantly changing and revaluations can be a complicated affair. Since the 1990 Revaluation and subsequent ones in 1995 and 2000, including the current 2005 Revaluation, we have successfully handled over 1,800 appeals on commercial properties throughout the UK. We have helped to significantly reduce occupier's rating assessments and assist to establish refunds and statutory interest on any over payment of rates. From 1 April 2010, all non-domestic subjects were reassessed for rates purposes. Each new Rateable Value formed the basis of a ratepayer's liability until 1st April 2015. The Rateable Value is a hypothetical rental value, at a point in time, based on certain assumptions. For the 2010 Revaluation, values are based on rents and costs prevailing as at 1 April 2008. Arguably, the 2010 Revaluation has been one of the most contentious to date, since the effect of the "Credit Crunch" on the property market has had a distorting effect on rental and cost levels, which will make it very difficult for the Assessors/Valuation Office Agency to reflect the correct level of rateable value. This situation may allow us the opportunity to argue for lower levels of assessment in our appeal negotiations. Anyone with an interest in a non-domestic property has an automatic right to appeal against the new assessment. In Scotland, appeals must be lodged within a limited period. ‘Material Change’ Appeal? In addition to the right of appeal against the original Revaluation assessment and as a new occupier etc. there is also, albeit a restrictive right, to appeal on what is commonly termed an ‘MCC’ basis. Namely ‘Material Change In Circumstances’. Due to the extent and severity of the recession generally and that it has become widespread practice for Landlords to be agreeing lease concessions with their tenants. During Revaluation negotiations (irrespective of its outcome), both parties are discovering (in general) such concessions have become widespread/common practice and in some cases quite substantial. It is for these reasons that after the conclusion of the outstanding Revaluation appeals further Hearings are being organised which will look at and investigate in detail whether these concessions constitute a justification for a further review of the currently adopted values. (Within the realms of Rating law). Should the above be proven and any resultant reductions agreed these further adjustments will be back dated to the start of the financial year in which the MCC appeal was submitted.
